Guillermo Garcia, who worked at Scorpion’s Metal, the family-owned recycler where the truck had stopped, was also severely burned when he approached the vehicle to inspect it. Garcia has filed suit, alleging the haulers gave no warning about the dangerous materials they were carrying.

According to court filings, the haulers had visited four other facilities on March 2 before arriving at Scorpion’s Metal, all of which refused to accept the material. The lawsuit also alleged that Golden Boy Waste Recycling, the small transport firm that initially collected the shavings, had previously been banned from similar facilities after starting a fire through improper disposal of metal shavings.

Texas law requires hazardous waste to be tracked from the point of generation through final disposal using a Uniform Hazardous Waste Manifest signed at every stage of the process. Police say those manifests were missing the magnesium shavings entirely, listing only a misspelled reference to “recyable metals shaving.”
